I. Check-In and Check-Out
Check-in and check-out time is 12:00pm. The Host will use reasonable efforts to have the premises ready for Guest(s) occupancy at check-in time.
Check-out time is strictly enforced so that the Host has adequate time to prepare the property for the next guest. The Guest is expected to hand over the keys upon a joint inspection to the Host or anyone expressly designated by the Host.
II. Late check-outs
Late check-outs will result in a fee of N10,000 every hour of the guest(s) extended stay on the premises.
III. Reservations
Reservations are not considered guaranteed until complete payments are made. To this end, payment validates booking. Where a guest pays only a percentage of the rental amount, he/she will only be permitted to stay for the duration corresponding to the amount paid.
IV. Confirmation of reservation(s)
Confirmation of the reservation will be emailed to the Guest upon receipt of the reservation advance payment.
V. Guarantor
The Guest shall for the purposes of this Agreement provide a Guarantor who is a reputable individual with a sustainable means of livelihood.
The Guarantor undertakes to accept liability and make good on any accrued rent or damages in the event of default by the Guest.
VI. Furnishing
The property is fully furnished and equipped for light housekeeping. See attached the inventory list for all items as contained in the apartment.
VII. Utilities
The Host shall be responsible for all utilities and services to the Premises as outlined below:
- Refuse Disposal
- Provision of security guards
- Maintenance of Utilities
- House keeping
- Electricity
- Water
- General Administration
VIII. House Keeping
Light housekeeping and taking out of the trash shall be carried out twice a week. You are expected to grant the Housekeeper entry into the premises and remain on the premises till the cleaning is over.
The Host shall not be held liable for any items reported missing in the event the housekeeper is left unsupervised.
The Guest is also advised to carry out personal cleaning where necessary.
IX. Extra Cleaning Services
In the event the Guest wishes to have extra cleaning services provided, a cleaning fee of up to N20,000 will be charged.
X. Electricity
Power shall be made available to the guest for a minimum of Ten (10) - Fifteen (15) hours daily using blended power of EKEDC, inverters and generators.
Inverters have been installed on the premises and shall supply power pending the return of power from other sources.
XI. Mechanical Failures / Repairs / Appliances
The Guest shall immediately report inoperative equipment to us through our Contact person or anyone so designated. We will make every effort to have repairs made as quickly as possible during reasonable hours.
The Host shall however not be responsible, nor will refunds be issued, for mechanical or electrical failures of items, including, but not limited to washing machines, Television, Satellite/Cable Service, Air Conditioning or any other appliance that fails to operate properly during your stay.
No refunds will be issued for minor disruption of any utilities including, but not limited to, power outages, water outages, etc.
Notwithstanding the above, the Host is at liberty to apply compensation in certain circumstances as it deems fit.
XII. Occupants
All occupants shall be bound by the terms of this Agreement. The maximum number of individuals staying on the Premises during the Lease Term shall be a total of Four (4) guests for the 2 bedroom and Six (6) for the 3 bedroom flat.
If more than the authorized number of guests permitted above are found on the Premises, this Agreement will be subject to penalties by the Host.
XIII. Caution Fee / Security Deposit
The Guest is required to pay a caution fee/security deposit equal to one day's booking rate for reservations of less than one week, and 10% of the total booking amount for stays exceeding one week.
The Caution fee shall be refunded to the Guest within Five (5) working days after the premises have been completely vacated, less any amount necessary to pay to the Host for cost for repair of damages to premises and/or common areas, and any other amount legally allowable under the terms of this agreement where applicable.
Where the caution fee does not cover such costs and damages, the Guest shall immediately pay said additional costs for damages to the Host.
XIV. Pets
Unless otherwise specifically permitted in writing, no pets shall be allowed on the Premises. Guest’s breach of this provision shall be considered material, and shall result in the termination of the Tenancy.
XV. Smoking and Use of Substances Policy
There shall be no smoking inside the premises; this includes the balconies, common areas and surrounding grounds.
Smoking will be permitted, at the personal risk of the Guest, away from the immediate grounds.
XVI. Illegal Activity
The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement without refund.
XVII. Partying and Loud Noise
Parties or gatherings of any kind are strictly prohibited within the apartment.
The guest agrees not to engage in any activities that may disturb the peace or disrupt the quiet enjoyment of the premises. Furthermore, the guest is expressly prohibited from attaching or affixing any nails, screws, balloons, or any other objects to the walls, ceilings, or any surfaces within the apartment, whether by piercing, taping, hanging, or using any other method. This includes, but is not limited to, decorations, posters, or any other items.
Any violation of this provision may result in withholding of the Caution fee by the Host or termination.
XVIII. Subletting
The Guest does not have the right to sublet the Premises.
XIX. Condition of Premises
The Guest stipulates that he/she has examined the leased PREMISES including the grounds and all buildings and improvements and that they are, at the time of this lease, in good order, repair and in a safe, clean tenantable condition.
XX. Right of Inspection
The Host has the right to inspect the premises without prior notice at any time in the event of an emergency, maintenance, a default or to enforce the terms of this agreement.
Every effort will be made to respect our Guests’ privacy with 24 hours notices prior to maintenance and/or repairs.
XXI. Inspection and Inventory
The Host shall by a checklist confirm on all items on the Premises. Parties will either carry out a joint inspection or the Guest shall be furnished with an inventory form prior to or upon check in to confirm on all items.
The Guest is mandated to inform the Host on the specific check out time to enable parties carry out a joint inspection of the premises in order to ascertain that all items are accounted for.
The Guest shall be liable for the cost of replacement of any items found missing upon a joint inspection by parties.
Where the Guest checks out prior to time agreed upon and without a joint inspection being carried out, the Guest shall be responsible for the cost of replacement of any missing items which shall be deducted from the Caution deposit.
XXII. Maintenance of Premises
Guests shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner.
Guests shall switch off all appliances not in use particularly when absent from the premises.
The Guests shall leave the premises in a ready to rent condition (as you found it) at the expiration of the rental agreement, defined by the Host as being immediately habitable by the next Guests. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition and should they exceed the security deposit.
Host shall deduct costs of said services from the security deposit prior to refund if Guests cause damage to the premises or its furnishings.
XXIII. Repairs and Maintenance
The Host shall be responsible for all repairs and maintenance of the premises not due to Guests misuse, water or neglect.
XXIV. Use of Property
Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that they do not intend to make the property a residence or household.
The premises shall be used and occupied by the Guest exclusively as a private residence. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.
XXV. Quiet Enjoyment
The Guests shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding guests, occupants and property owners and shall not create noise or disturbances likely to cause annoyance.
XXVI. Host’s Liability
The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss.
The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.
XXVII. Force Majeure
The Host shall not be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, or inclement weather.
No Refunds are issued in these circumstances. You may reschedule according to availability.
XXVIII. Waiver of Rights
The Guest hereby expressly waives any rights to challenge a valid termination in court AND accepting that by signing the agreement he/she is deemed to have been served all notices required in law.
XXIX. Possessions
Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest and will not be liable where such items cannot be returned.
XXX. Breach of Contract and Agreement
If Guest(s) violates any of the conditions of this agreement, Host may terminate this Agreement and enter premises.
Upon notice of termination of this agreement, Guest(s) shall vacate the premises immediately and forfeit all payments.
XXXI. Governing Law
The governing law of this Agreement shall be the Laws of the Federal Republic of Nigeria.
